According to ChainCatcher, crypto journalist Eleanor Terrett wrote on the X platform that, looking back at the trial of Tornado Cash co-founder Roman Storm, Judge Failla used a self-driving car analogy in user Nessa Risle's lawsuit against Uniswap, and seemed to show more sympathy for the developers behind Uniswap, while being stricter with the developers of Tornado Cash.
According to materials forwarded by Eleanor Terrett, the judge's view was that holding software developers responsible for the misuse of neutral infrastructure by strangers would be illogical. Specifically, Uniswap was considered "neutral infrastructure," while Tornado Cash was deemed to have "participated in illicit financial activities" (knowingly continuing to operate after being used for money laundering). This statement suggests that US courts may consider whether developers merely provided neutral tools, rather than engaging in illegal activities, when determining liability for decentralized finance (DeFi) infrastructure in the future.
