PANews reported on May 18 that according to HT, lawyers for Samourai Wallet and Tornado Cash accused prosecutors of concealing a phone call they believe could be crucial to their defense. During the call, a senior FinCEN employee suggested to government prosecutors that non-custodial protocols might not qualify as money services businesses, which is a key element of some charges. Prosecutors in the Samourai case downplayed these allegations, stating that the phone call was fairly disclosed before the trial and represented an "informal personal opinion" of an employee.
Previous report, Bitcoin privacy wallet Samourai Wallet developers rejected charges and requested dismissal, with the case still stuck in a legal deadlock.
