Market structure legislation doesn't have to be zero sum. Crypto, banks and regulators can all win if the focus remains on what's best for everyday Amercans. Treating staking like a security doesn’t protect consumers–it locks them out of earning rewards on crypto they already own. We’re making real progress toward giving residents in Maryland equal access to the same safe and secure staking services available in nearly every other state.

Congress has said explicitly what swaps are subject exclusively to federal oversight—and what are not. Under Article I of the Constitution, that's all that matters. Feels, vibes and duck tests are irrelevant.
