Tornado Cash case prosecutors cite misinformation to prove "guilty consciousness"

Planet Daily News: At the pre-trial hearing of Tornado Cash developer Roman Storm, the U.S. Southern District Attorney mistakenly attributed a Telegram message inquiring "how to cash out $600 million" to the development team as evidence of their "criminal intent". Defense documents reveal that the message was actually written by a CoinDesk reporter and forwarded by Alexey Pertsev to the Tornado Cash group. The prosecution acknowledged that the originally provided chat records lacked a "forwarded" label, causing misunderstanding, but stated that a corrected version was provided in December 2024. Storm's defense team requested the exclusion of all Telegram evidence from Pertsev's phone and questioned the integrity of the grand jury procedure. Pertsev has already been sentenced to 64 months in prison by a Dutch court for assisting money laundering. ()
