According to ChainCatcher and Cointelegraph, the legal team of Samourai Wallet's founders sent a letter to the Manhattan Federal Court on May 5th, revealing that the prosecution allegedly concealed crucial evidence. It is reported that the Financial Crimes Enforcement Network (FinCEN) of the U.S. Treasury Department had clearly stated six months before the prosecution that Samourai Wallet did not need to apply for an MSB (Money Services Business) license. However, the prosecution still filed a lawsuit against the founders on the grounds of "operating without a license" and concealed this key information for a year and a half.
The two defendants, Rodriguez and Hill, were previously charged with assisting in illegal transactions exceeding $2 billion. Currently, the legal team has requested a hearing from the court regarding the prosecution's delayed disclosure of evidence and stated that they will resubmit a motion to dismiss the charges.
