According to Protos, as reported by Foresight News, US prosecutors have filed a motion to prevent expert witnesses for Tornado Cash founder Roman Storm from testifying. Prosecutors claim they are a "Trojan horse" that will "waste jury time" and confuse jurors' understanding of privacy, token economics, and KYC.
As previously reported by Cointelegraph and Foresight News, Roman Storm's lawyers have filed a motion asking the court to reconsider the dismissal request, accusing prosecutors of concealing evidence of communications with FinCEN in 2023. Documents show that non-custodial crypto mixers do not fall under the legal definition of "money transmission services", and prosecutors have been aware of this guidance since 2023 but continue to prosecute Samourai Wallet and Tornado Cash developers.
